These Terms of Service ("Terms") are a binding agreement between you and Halsus Digital LLC ("we," "us," or "our"), governing your access to and use of the MX VPN mobile application and related services (collectively, the "Service"). Please also review our Privacy Policy, which explains how we collect and handle information and is incorporated into these Terms by reference.
By downloading, installing, accessing, or using MX VPN, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance and Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, to create an account or use MX VPN. If you are accessing or using the Service on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity. By using the Service, you represent and warrant that you meet these eligibility requirements.
2. The Service
MX VPN is a consumer virtual private network application for Android and iOS that encrypts and routes your device's internet traffic through our servers, using modern tunneling technologies selected automatically for reliability, with particular attention to users on restrictive or heavily censored networks. The App is free to download and use and contains no purchases. MX VPN is offered on a free tier, subject to a daily data allowance and optional rewarded advertisements, and a premium tier, which we activate on an account at our discretion. We may add, change, or remove features of the Service from time to time as described in Section 7.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to notify us promptly at [email protected] if you become aware of any unauthorized use of your account. We may limit the number of devices that may be connected under a single account, consistent with your plan's device limit.
4. License Grant and Intellectual Property
Subject to your compliance with these Terms, Halsus Digital LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the MX VPN application on devices you own or control, solely for your own personal, non-commercial use, and solely in the manner permitted by these Terms and by the app store from which you downloaded it. This license does not grant you any right to sublicense, sell, rent, lease, distribute, or otherwise transfer the App or your access to the Service.
The MX VPN name, logo, application, and all related software, designs, text, graphics, and other content (excluding your own account data) are owned by Halsus Digital LLC or its licensors and are protected by intellectual property laws. Except for the limited license above, no rights are granted to you in or to the Service, and all rights not expressly granted are reserved by Halsus Digital LLC.
5. Acceptable Use
MX VPN is built as a privacy and anti-censorship tool intended for lawful use — to help people access the open internet privately and securely, particularly where local networks are restricted or monitored. You agree not to use the Service to:
- Engage in or facilitate any illegal activity under the laws applicable to you;
- Gain or attempt to gain unauthorized access to any computer system, account, or network ("hacking"), or to probe, scan, or test the vulnerability of any system without authorization;
- Engage in fraud, phishing, or any deceptive practice intended to obtain money, credentials, or information from others;
- Send spam, unsolicited bulk communications, or engage in any similar abusive messaging conduct;
- Develop, distribute, or transmit malware, viruses, ransomware, or other harmful code;
- Infringe the intellectual property, privacy, or other legal rights of any person or entity;
- Harass, threaten, stalk, or otherwise harm or attempt to harm another person;
- Circumvent, disable, or interfere with the security, rate limits, or data-quota mechanisms of the Service, or attempt to reverse engineer the App beyond what is permitted by applicable law;
- Resell, sublicense, or provide the Service to third parties as your own service without our prior written consent.
We may investigate suspected violations of this Section and may suspend or terminate accounts involved in violations, consistent with Section 7. Because MX VPN does not log the content or destinations of your traffic (see our Privacy Policy, Section 1), our ability to detect violations is generally limited to account-level signals such as abuse reports or aggregate abnormal usage patterns, and to information we are lawfully required to act upon.
6. Advertising
If you use the free tier, the App may display rewarded video advertisements through Google AdMob that you may choose to view in exchange for additional daily data, as described in our Privacy Policy. Premium users are not shown advertisements. Advertisements are provided by third-party advertising networks, and your interactions with them are also subject to those networks' own terms.
7. Service Availability, Modification, Suspension, and Termination
7.1 Availability and Changes
We work to keep MX VPN reliable, but we do not guarantee that the Service will be uninterrupted, error-free, or available at all times, particularly given that MX VPN is often used on restrictive or unstable networks outside our control. We may modify, suspend, or discontinue any part of the Service, including specific servers or features, at any time, with or without notice, for reasons including maintenance, security, legal compliance, or changes to our business.
7.2 Suspension and Termination by Us
We may suspend or terminate your account or access to the Service, in whole or in part, if we reasonably believe you have violated these Terms (including Section 5), if required by law, or to protect the security or integrity of the Service or other users. Where practicable and lawful, we will make reasonable efforts to notify you of the reason.
7.3 Termination by You
You may stop using the Service and delete your account at any time by contacting [email protected], as described in our Privacy Policy. The App is free to use, so ending your account costs you nothing.
7.4 Survival
Sections 4 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), 11 (Governing Law and Dispute Resolution), and this Section 7.4 survive termination of these Terms.
8. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT IT WILL SUCCESSFULLY CIRCUMVENT EVERY FORM OF NETWORK RESTRICTION OR CENSORSHIP ON EVERY NETWORK, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK, INCLUDING WITH RESPECT TO YOUR COMPLIANCE WITH LAWS APPLICABLE TO YOU IN YOUR JURISDICTION.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you, in which case they apply to the maximum extent permitted by applicable law.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HALSUS DIGITAL LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HALSUS DIGITAL LLC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED FIFTY U.S. DOLLARS ($50).
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you, in which case they apply to the maximum extent permitted by applicable law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Halsus Digital LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: your violation of these Terms; your violation of any applicable law or the rights of a third party; or your use or misuse of the Service, including any content you access, transmit, or receive through it.
11. Governing Law and Dispute Resolution
These Terms, and any dispute arising out of or related to them or the Service, are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws principles, and without regard to the United Nations Convention on Contracts for the International Sale of Goods. Subject to any mandatory consumer-protection rights you may have in your place of residence, you agree that the state and federal courts located in New Mexico will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, and you consent to the personal jurisdiction of those courts. Before initiating a formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting [email protected]; we will attempt to resolve the dispute informally as well.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Service or applicable law. If we make a material change, we will update the "Last updated" date above and, where appropriate, provide notice within the App. Your continued use of MX VPN after a change takes effect constitutes your acceptance of the updated Terms. If you do not agree to an update, you must stop using the Service.
13. Miscellaneous
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Halsus Digital LLC regarding the Service and supersede any prior agreements on this subject.
Severability. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.
No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.
Third-Party Platforms. If you downloaded MX VPN from the Apple App Store or Google Play Store, your use of the Service is also subject to that platform's own usage terms, and, in the case of Apple, Apple is a third-party beneficiary of these Terms with the right to enforce them against you, but is not a party to and has no obligations under these Terms.
Export Compliance. You agree to comply with all applicable export and re-export control laws in connection with your use of the Service.
